Online Course Participation Agreement

Purchase of this course indicates agreement to the following terms:

1. Program Participation

The Purchaser agrees to commit to this program in its entirety, which includes virtual peer group calls across two semesters. 

2. Collaboration with Tamarind Learning

The Participant acknowledges and agrees that access to the Tamarind Learning Accredited Beneficiary Stewardship program is granted by purchase of this course. However, the purchaser acknowledges that In Three Generations has no control over the Tamarind Learning Platform and its continuance. Access to the Accredited Beneficiary Stewardship program will be granted for 12 months from access date after which time the course access will be revoked. Should the purchaser wish to continue access to the Accredited Beneficiary Stewardship program the purchaser can purchase ongoing access directly from Tamarind Learning. 

3. Refund

The purchaser has one month from the point of purchase to request a refund in writing. In Three Generations retains the right to refuse refund if the purchaser requesting refund has consumed significant course materials beyond the recommended lessons as evidenced by the administrative platform data. 

4. Intellectual Property

All course materials, including but not limited to videos, audio recordings, text, graphics, and images, are the property of Tamarind Learning and/or In Three Generations and are protected by copyright laws. As such, the Purchaser agrees not to reproduce, distribute, or share unlawful access to any course materials without the prior written consent of In Three Generations, LLC. 

5. Liability Release

The Purchaser acknowledges that In Three Generations and its contractors hold no responsibility for the actions or statements of any participant in the program. Furthermore the Purchaser is aware that In Three Generations’ Coaches do not provide counseling or psychological services - nor do they offer insurance, accounting, legal, cash management, investment, estate planning or other financially-related licensed services. Any recommendations by a Coach or other peer group member having psychological, accounting, tax, financial, or legal implications are only suggestions to be reviewed by the Purchaser's advisors, and any action taken by the Purchaser as a result of the information learned via the Tamarind Learning course or by the advice of other program participants or coaches is solely the responsibility of the Purchaser.

6. Release

The Purchaser agrees to release and hold harmless In Three Generations, its officers, directors, contractors, agents, and representatives from any and all claims, liabilities, damages, and expenses arising from or related to the Purchaser's participation in this virtual program.

7. Acknowledgement of Risk

The Purchaser understands that participation in the online course(s) involves risks, including but not limited to risks associated with the use of technology, and that In Three Generations is not responsible for any technical difficulties, disruptions, or failures.

8. Errors and Omissions

In Three Generations shall not be liable for any errors, omissions, or inaccuracies in the course materials, content, or information provided in the program, and makes no representations or warranties about the accuracy, completeness, or reliability of the course materials or information provided. The Purchaser acknowledges that they are responsible for verifying the accuracy and reliability of any information or materials obtained from the online course(s).

9. Confidential Handling of Non-Public Information

The Purchaser acknowledges that the participants in the group depend upon one another to add the value of their perspectives and experiences. The Purchaser further acknowledges that in the course of the program other participants may share nonpublic information. The purchaser agrees to hold nonpublic information shared by other participants with strict confidentiality, meaning that the Purchaser will not share information shared in the program with anyone outside the program under any circumstances. Furthermore, the Purchaser understands that that violation of this agreement of confidentiality is grounds for immediate removal from the peer group program with no refund.

During the course of the program the Purchaser may choose to disclose nonpublic information to the group including the coaches. The program coaches will hold such information in confidence, not releasing it to anyone outside of In Three Generations, except as required under applicable law or governing codes of rules of professional conduct. If In Three Generations is served with legal process mandating the disclosure of confidential information, the Purchaser will be notified immediately. 

The Purchaser agrees to use discretion in sharing, acknowledging that there is no way to guarantee that nonpublic information is kept confidential by other participants. Should nonpublic, confidential information be shared inappropriately by a peer group participant, the Purchaser agree sto fully indemnify and hold In Three Generations’ founder, coaches, contractors, affiliates, agents, attorneys, independent consultants, representatives and members harmless from any and all losses, damages, liabilities, claims, demands, suits, or causes of action (including reasonable attorneys’ fees and costs).

10. Indemnification

The Purchaser agrees to indemnify and hold harmless In Three Generations, its officers, directors, employees, agents, and representatives from any and all claims, liabilities, damages, and expenses arising from or related to the Purchaser's breach of this Agreement or any of the Purchaser's actions or statements in connection with the online program).

11. Termination

The Company reserves the right to terminate the Purchaser's access to the online program at any time for just cause which may include a lack of participation in the Tamarind platform and/or group calls for more than 2 months time. No refund will be offered upon just cause termination.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Florida without regard to its conflict of laws provisions.

13. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior or contemporaneous agreements, representations, and understandings, whether written or oral.

14. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Waiver

In Three Generation's failure to enforce any provision of this Agreement shall not constitute a waiver of their right to enforce such provision in the future.

16. Miscellaneous

This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument.

17. Format

The headings of this Agreement are for convenience only and shall not affect the interpretation of this Agreement.

18. Amendment

This Agreement may be amended only by a written agreement executed by both parties.

19. Acknowledgment

The Purchaser acknowledges that they have read and understand this Agreement and agree to be bound by its terms.
